O ministro Flávio Dino, do STF, emitiu uma decisão importante no último domingo, 24, determinando que o município de São Paulo retome a comercialização e a cobrança de serviços funerários com preços limitados aos valores praticados antes da privatização, ajustados pelo IPCA até a data da decisão. Essa medida visa garantir que os cidadãos tenham acesso a serviços funerários dignos e acessíveis.
A decisão também abrange os serviços cemiteriais e os serviços de cremação, que devem ser oferecidos com preços justos e transparentes. Além disso, a medida visa evitar que os preços desses serviços sejam abusivos e causem prejuízos aos cidadãos. A transparência e a justiça são fundamentais em momentos de dor e perda, e é importante que os serviços funerários sejam oferecidos de forma ética e responsável. Privatização de Serviços Funerários em São Paulo
A ação movida pelo PCdoB questiona a constitucionalidade de duas leis municipais de São Paulo (leis 17.180/19 e 16.703/17) que transferiram a gestão dos serviços funerários para a iniciativa privada. Segundo o partido, essas normas violam a lei orgânica do município, que atribui à administração pública municipal a responsabilidade por esses serviços e a fiscalização dos cemitérios privados. Além disso, o PCdoB argumenta que a privatização tem levado à exploração comercial desenfreada dos serviços funerários, serviços de cremação e serviços cemiteriais, prejudicando a população paulistana.
Abusos Relatados e Decisão do Ministro
Na decisão, o ministro Flávio Dino acolheu parcialmente os pedidos feitos pelo autor e mencionou reportagens anexadas ao processo que denunciam práticas abusivas contra cidadãos que necessitam desses serviços funerários. Para o ministro, embora a privatização tenha como objetivo modernizar a prestação pública, há indícios de que as práticas adotadas pelas concessionárias resultaram em graves violações a diversos preceitos fundamentais, entre os quais a dignidade da pessoa humana e a obrigatoriedade de manutenção de serviço público adequado e plenamente acessível às famílias. Além disso, o ministro afirmou que, no estágio atual do processo, há evidências de que as práticas comerciais das concessionárias desrespeitam a Constituição, o que justifica a concessão de uma medida cautelar.
Limitações da Decisão e Discussão no Plenário do STF
A decisão limita-se a suspender os efeitos das práticas de cobrança consideradas abusivas, enquanto a questão mais ampla permanece em discussão. O ministro esclareceu que a decisão definitiva sobre a constitucionalidade da privatização será analisada pelo plenário do STF no julgamento de mérito. Além disso, a decisão também determina um teto para os valores dos serviços funerários no município de São Paulo, visando proteger a população de práticas abusivas e garantir o acesso a serviços funerários, serviços de cremação e serviços cemiteriais de qualidade.
